1. Acceptance of Terms

By accessing and using the services, website, and facilities of Marée (operated by SL1901, LLC, a New Jersey Limited Liability Company, "we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this service.

2. Services Provided

2.1 Restaurant and Bar Services

Marée operates as a full-service restaurant and bar open to the general public. We provide food, beverage, and hospitality services in accordance with all applicable New Jersey laws and regulations.

2.2 Wine Locker Program

In addition to our public restaurant and bar services, we offer an optional wine locker program that provides enhanced benefits to participants. Participation is not required to dine at or visit Marée.

2.3 Events and Private Dining

We offer public and private events, tastings, and special dining experiences. Specific terms and availability will be communicated as needed. Private events will use no more than 50 percent of the premises, and regular restaurant service will continue during those times.

3. General Restaurant Policies

3.1 Reservations

Reservations are subject to availability. We may adjust our reservation policies from time to time, including limiting the number of reservable tables or capping certain timeslots during peak periods. Any changes will be communicated with reasonable notice to ensure a smooth experience for all guests.

3.2 Cancellation Policy

For all reservations, we request cancellation notice at least 24 hours in advance. No-shows or repeated late cancellations may result in reservation restrictions.

3.3 Service and Conduct

We reserve the right to refuse service to anyone. All guests are expected to conduct themselves respectfully toward staff and other patrons. Harassment, discrimination, or disruptive behavior will not be tolerated and may result in removal from the premises.

3.4 Age Requirements

Guests must be 21 years or older to consume alcohol. Valid identification will be required. We comply with all New Jersey alcohol service laws and regulations.

4. Wine Locker Program Terms

4.1 Application and Approval

Applications are subject to approval by Marée. We reserve the right to accept or decline any application at our sole discretion. Approval is not guaranteed.

4.2 Program Fees

All program fees, including initiation fees and annual dues, are non-refundable. Fees are subject to change with 30 days' notice to participants. Founding participants are guaranteed their rate lock as specified in their membership agreement.

4.3 Payment Terms

Payment is processed via Stripe. By providing payment information, you authorize us to charge the applicable program fees. All payments must be made in US Dollars.

4.4 Program Benefits

Program benefits are as described in your wine locker membership. Benefits are subject to availability and may be modified with reasonable notice. Certain benefits exclude alcohol and gratuity unless otherwise specified.

4.5 Participant Conduct

Participants are responsible for their guests' conduct and must comply with all house policies when visiting Marée.

5. Wine Locker Terms

5.1 Locker Security

Wine lockers are climate-controlled and secured. Marée is not responsible for loss or damage beyond reasonable care.

5.2 Permitted Use

Locker contents must comply with applicable laws and Marée policies. Lockers are for personal wine storage only and may not be used for commercial purposes.

5.3 Termination

Upon program termination, participants have 30 days to remove locker contents. Unclaimed items may be disposed of or sold at Marée's discretion.

6. Payment and Billing

6.1 General Payment Terms

We accept various forms of payment for restaurant services. All bills must be settled before departure. Gratuity is not included unless otherwise specified.

6.2 Program Payments

Program fees are processed through Stripe. Participants are responsible for maintaining current payment information and ensuring sufficient funds for recurring charges.

6.3 Disputed Charges

Any billing disputes must be reported within 30 days of the charge. We will work in good faith to resolve legitimate billing issues.

7. Program Termination and Suspension

7.1 Voluntary Termination

Participants may terminate their program participation with 30 days' written notice. No refunds will be provided for any fees paid.

7.2 Involuntary Termination

We reserve the right to suspend or terminate any program participation for violation of these terms, non-payment, or conduct detrimental to Marée or its wine locker program participants. No refunds will be provided in cases of involuntary termination.

8. Marée Creators Program Terms

These terms apply to the Marée Creators program and are the "Marée Creators guidelines" referenced on the Creators page. Submitting an application means you accept them.

8.1 Eligibility and Approval

Participation is by application and is granted at Marée's sole discretion. We may decline any application without explanation. Only the social accounts listed in your approved application count toward the program; accounts added afterward must be submitted to us and approved before content from them qualifies.

8.2 Your Visit

You dine as a regular paying guest and are responsible for your full check, including tax and gratuity. The program does not comp meals. Any dining credit you earn is issued after your content is reviewed and applies to a future visit. A complimentary drink or dessert offered at the table is a courtesy, not compensation, and is separate from dining credit.

8.3 Content and Submission

To qualify, content must be published within 3 days of your visit, tag @eatatmaree, and invite Marée as a collaborator where the platform supports it. After the content has been live for at least three days, send us the link and a screenshot of its insights. Content must be your own original work and must remain publicly available while it is being credited.

8.4 Organic Reach Only

Credit is based on genuine, organic reach. Paid promotion, boosted posts, purchased engagement, and artificially generated engagement are excluded from the impression counts used to determine credit. Submitting altered insights or artificially inflated metrics is grounds for immediate removal from the program and voiding of any unredeemed credit.

8.5 Disclosure

You are responsible for clearly and conspicuously disclosing your relationship with Marée on any content for which you receive dining credit, using the platform's partnership or paid-partnership label or a clear written disclosure. This is required by the U.S. Federal Trade Commission's endorsement guidelines and by each platform's own policies. Marée does not control and is not responsible for your compliance, but content that is not properly disclosed will not be credited.

8.6 Content License

Your content remains yours. By submitting it, you grant Marée a non-exclusive, royalty-free, worldwide license to reshare and display that content on Marée's own channels and marketing materials with attribution to you. You may ask us to stop using a specific piece of content at any time by emailing [email protected]. This license does not permit Marée to run your content as paid advertising without the separate approval described in 8.8.

8.7 Dining Credit

Credit amounts follow the published rate card and are capped at $250 per qualifying post. Credit is issued only after we review the submitted insights, takes the form of a Marée gift card, and may be earned once per month, with at least 14 days between credited visits. A post featuring more than one spot, commonly called a roundup, qualifies only if Marée appears within the first three places featured, counting slides in a carousel or entries in a list, and it earns 50% of the listed rate. Once issued, the gift card is governed by our standard gift card terms. Credit is non-transferable before it is issued and may not be combined with other offers unless we say otherwise. Dining credit may be treated as taxable income; you are responsible for your own tax reporting.

8.8 Paid Partnerships

Paid campaigns are separate from the Marée Creators program and are offered at Marée's discretion by invitation only. Opting in on the application means only that we may contact you about such opportunities. Any paid campaign, and any use of your content as a paid advertisement, requires your separate written approval for that specific campaign or post and is governed by its own agreement.

8.9 Independent Relationship

Participation does not create an employment, agency, partnership, or joint venture relationship. You are not authorized to speak on Marée's behalf, and your content is your own opinion. We do not review, approve, or script your content.

8.10 Suspension and Changes

We may suspend or end anyone's participation, and may modify or discontinue the program and its rate card, at any time. Credit already issued and unexpired will be honored except where it was earned through misrepresentation or the conduct described in 8.4.

8.11 Your Information

Information you submit is handled under our Privacy Policy. We use it to review your application, administer the program, and contact you about it.

9. Limitation of Liability

Marée and SL1901, LLC, along with its owners, operators, and staff, shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services or facilities. Our total liability shall not exceed the amount of fees paid by you in the twelve months preceding any claim.

We are not responsible for lost or stolen personal property. All patrons use our facilities at their own risk.

10. Intellectual Property

All content on the Marée website and marketing materials, including text, graphics, logos, and images, is the property of SL1901, LLC and protected by applicable copyright and trademark laws. Unauthorized use is prohibited.

11. Health and Safety

We maintain health and safety standards in accordance with New Jersey Department of Health regulations. Guests with food allergies or dietary restrictions should inform their server. While we make every effort to accommodate dietary needs, we cannot guarantee allergen-free preparation.

12. Modifications to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated to participants via email and posted on our website. Continued use of our services after changes constitutes acceptance of the modified terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Monmouth County, New Jersey.
